align=\"justify\"><b><span style=\"text-decoration: underline;\">CONDICIONES DE LA SUBASTA.<\/span><\/b><br \/>\nEl d\u00eda 28 de noviembre de 2018, a partir de la hora 10 en la calle Fernando Otorgues 1219 de Montevideo, se sacar\u00e1n a la venta, en REMATE OFICIAL, los veh\u00edculos automotores que se dir\u00e1n, en desuso, propiedad de la Administraci\u00f3n de las Obras Sanitarias del Estado (O.S.E). Intervendr\u00e1n en la subasta los Rematadores designados al efecto por la Comisi\u00f3n Administradora del Registro Nacional de Rematadores y por la Asociaci\u00f3n Nacional de Rematadores, Tasadores y Corredores Inmobiliarios, quienes actuar\u00e1n bajo el contralor y administraci\u00f3n de \u00e9sta \u00faltima o de quien \u00e9sta designe. El remate se realizar\u00e1 sujeto a las siguientes condiciones, que conjuntamente con las disposiciones aplicables, regular\u00e1n los actos a cumplirse:<\/p>\n<p>PRIMERO: Los veh\u00edculos automotores que saldr\u00e1n a la venta son los que figuran en la n\u00f3mina adjunta a las presentes actuaciones, la misma que se plasmara en las distintas publicaciones a realizar tanto por la Administraci\u00f3n como por La Asociaci\u00f3n Nacional de Rematadores.<br \/>\nSEGUNDO: Los bienes se rematar\u00e1n a la vista y en su actual estado de conservaci\u00f3n y se encontrar\u00e1n en exhibici\u00f3n el 26 y 27 de noviembre de 2018 en la calle Fernando Otorgues 1219 de Montevideo en el horario de 12 a 16 hs. La documentaci\u00f3n existente respecto de los veh\u00edculos automotores se exhibir\u00e1 a los interesados, en Fernando Otorgues 1219 de Montevideo, los mismos d\u00edas de exhibici\u00f3n (26 y 27 de noviembre) y en el mismo horario.<br \/>\nTERCERO: Los bienes saldr\u00e1n a la venta en D\u00f3lares Estadounidenses, sin base y al mejor postor. Los mejores postores deber\u00e1n depositar, como m\u00ednimo, en el acto de bajarse el martillo la suma equivalente al 30% del precio aceptado (en D\u00f3lares) Dicha se\u00f1a, se considerar\u00e1 parte integrante del precio. Ajust\u00e1ndose a las disposiciones tanto de la Administraci\u00f3n como de la nueva Ley N\u00b0 19.210 se establecen como forma de pago:<br \/>\n&#8211; En el caso de lotes superiores a 40.000 UI: se aceptar\u00e1n \u00fanicamente CHEQUE CRUZADO, no a la orden (librado a OSE), LETRA DE CAMBIO CRUZADA emitida por instituci\u00f3n financiera de plaza a nombre del adquirente, o TRANFERENCIA BANCARIA EN DOLARES en cuenta BROU de OSE.<br \/>\nPara lotes inferiores a 40.0000 UI: adem\u00e1s de los medios de pago contemplados en \u00edtem anterior, se aceptar\u00e1 pago en efectivo.<\/p>\n<p>Cada lote deber\u00e1 pagarse de forma independiente sea cual sea el medio de pago (a cada lote le corresponder\u00e1 un documento).CUARTO: Ser\u00e1 de cargo de los mejores postores en el acto de bajarse el martillo, el pago de la comisi\u00f3n de los Rematadores m\u00e1s impuestos, que asciende al 15% del monto de la oferta aceptada m\u00e1s IVA (en D\u00f3lares Estadounidenses).<\/p>\n<p>La comisi\u00f3n e impuestos no integran el precio. La forma de pago de los mismos, debe ajustarse a las disposiciones establecidas por la Administraci\u00f3n en cumplimiento a la vigente ley 19210 de Inclusi\u00f3n Financiera. Asimismo ser\u00e1n de cargo de los compradores los gastos de certificados y dem\u00e1s documentaci\u00f3n que deban obtener a efectos de otorgar el t\u00edtulo de propiedad y transferencia municipal o re empadronamiento a su nombre de tales veh\u00edculos, honorarios y dem\u00e1s gastos que se generen por tales conceptos. QUINTO: Una vez concluida la subasta, cada mejor postor deber\u00e1 exhibir su documento de identidad, constituir domicilio legal, proporcionar un n\u00famero de tel\u00e9fono en el cual ser\u00e1 contactado y designar en el mismo acto un Escribano que habr\u00e1 de intervenir a efectos de realizar el t\u00edtulo de propiedad de los veh\u00edculos. SEXTO: La se\u00f1a se destinar\u00e1 a garantizar las obligaciones que asume el mejor postor, quien, al formular postura, se entiende que acepta estas condiciones. SEPTIMO: a) Dep\u00f3sito del saldo: El mejor postor dispondr\u00e1 de un plazo de 48 horas h\u00e1biles a partir del d\u00eda siguiente a la subasta para completar el saldo. Si dentro del plazo indicado el mejor postor no cumpliera con el pago del saldo de precio, perder\u00e1 sin derecho a reclamo alguno, el importe o los importes pagos por concepto de se\u00f1a y la comisi\u00f3n e impuestos que hubiere abonado, sin perjuicio de los da\u00f1os y perjuicios que hubiera ocasionado; b) Documentaci\u00f3n relativa a los veh\u00edculos: Los mejores postores tendr\u00e1n a su disposici\u00f3n la documentaci\u00f3n existente respecto de los veh\u00edculos, al momento del retiro del mismo siempre que hubieran abonado la totalidad del precio en forma previa. c) Retiro de los bienes: El mejor postor deber\u00e1, una vez concluido el pago total del bien y con factura original a la vista (la factura se emitir\u00e1 una vez verificado el ingreso de los fondos a las arcas del organismo) agendarse para su retiro, llamando al tel\u00e9fono 22030515 internos 310, 326 los d\u00edas 29 y 30 de noviembre de 2018, en horario de 09:00 a 16 horas. La efectiva entrega de los bienes se realizar\u00e1 desde el 29 de noviembre al 12 de diciembre inclusive (supeditada al pago total del lote adquirido), en horario de 09:00 a 16 horas y sujeto a la disponibilidad de la agenda. En caso de no proceder al retiro de los bienes dentro del plazo mencionado precedentemente, a partir del d\u00eda 13 de diciembre 2018, deber\u00e1 abonar una multa de 1 UR (Unidad Reajustable) por cada d\u00eda h\u00e1bil hasta su efectivo retiro. De no retirarlos en un plazo de 30 d\u00edas corridos, a contar de la fecha del remate, perder\u00e1 sin derecho a reclamo alguno, todo importe depositado, sin perjuicio del derecho de OSE de cobrar lo que se adeude por concepto de multas. Los bienes deber\u00e1n ser retirados por los mejores postores en forma personal, o en caso de enviar un representante, el mismo deber\u00e1 estar facultado mediante poder general o carta poder especial con firmas certificadas notarialmente, que deber\u00e1 exhibir, conjuntamente con certificado notarial de vigencia expedido al d\u00eda anterior al del retiro. OCTAVO: Respecto de los veh\u00edculos: a) Se encuentran sin deudas municipales, con chapas y libretas oficiales entregadas en las respectivas comunas y sin multas de Polic\u00eda de Tr\u00e1nsito seg\u00fan reporte adjunto a la documentaci\u00f3n que ser\u00e1 entregada al mejor Postor. b) No cuentan con inspecci\u00f3n t\u00e9cnica vehicular vigente. Se hace constar que de acuerdo a la resoluci\u00f3n reca\u00edda en el expediente de la Intendencia Municipal de Montevideo n\u00famero 2016-7411-98-000049, que remite al expediente 7411002627-14: \u201cpara este caso y a modo de excepci\u00f3n, teniendo en cuenta que con las transferencias de oficio no se solicitaba la inspecci\u00f3n t\u00e9cnica vehicular, se tomar\u00e1 id\u00e9ntico criterio\u201d. No obstante, se establece que en caso de que fuera indispensable la realizaci\u00f3n de esta inspecci\u00f3n, o para el caso de que el Municipio en donde est\u00e9 empadronado el veh\u00edculo exigiera que el veh\u00edculo se encuentre en determinadas condiciones, ser\u00e1 de cargo del mejor postor el pago de la inspecci\u00f3n t\u00e9cnica correspondiente, de las reparaciones, puesta a punto y cumplimiento de todo requisito que se exija por la autoridad y de los traslados de los veh\u00edculos. c) El mejor postor deber\u00e1 otorgar el t\u00edtulo de propiedad, proceder a su inscripci\u00f3n y realizar la transferencia municipal y\/o re empadronamiento a su nombre (no se otorgar\u00e1 t\u00edtulo a nombre de personas diversas del mejor postor), disponiendo de un plazo m\u00e1ximo de 45 d\u00edas corridos a partir de la subasta. d) Una vez efectuados los tr\u00e1mites indicados en el literal c) y dentro de los plazos indicados (45 d\u00edas corridos a partir de la subasta), el mejor postor deber\u00e1 exhibir en Oficinas de Divisi\u00f3n Escriban\u00eda de OSE (Carlos Roxlo 1275, piso 5) originales de libreta municipal a su nombre y t\u00edtulo de propiedad inscripto tambi\u00e9n a su nombre, debiendo proporcionar a dicha Divisi\u00f3n en el mismo acto, copia de los mismos. e) Ser\u00e1n de cargo del mejor postor, a partir de la fecha de la subasta, todos los gastos y tributos que la ley y\/o la reglamentaci\u00f3n pone de cargo del comprador, incluidos patente y seguro, y a partir de la fecha de entrega, asumir\u00e1 todas las responsabilidades civiles, penales, administrativas y\/o de cualquier otra naturaleza que con el veh\u00edculo se produzcan, tanto sea a bienes como a personas, deslindando a OSE de toda responsabilidad. f) OSE oficiar\u00e1 a cada Intendencia el resultado del remate y los datos del mejor postor. g) En caso de paros y\/o conflictos que afecten la obtenci\u00f3n de la documentaci\u00f3n necesaria para efectuar el t\u00edtulo de propiedad, el plazo se prorrogar\u00e1 autom\u00e1ticamente hasta que se est\u00e9 en condiciones de obtener la referida documentaci\u00f3n, sin responsabilidad para el mejor postor. h) Los derechos de mejor postor son intransferibles. S\u00f3lo se otorgar\u00e1 el t\u00edtulo a nombre de quien figura en el acta como mejor postor. i) No podr\u00e1 el mejor postor negarse a realizar el t\u00edtulo de propiedad de los veh\u00edculos bajo ning\u00fan concepto. Quien se presente a la subasta y formule postura acepta el estado actual del veh\u00edculo, la documentaci\u00f3n relativa a los mismos y las condiciones del remate. NOVENO: Los martilleros actuar\u00e1n con sujeci\u00f3n a las disposiciones legales y reglamentarias que regulan su actividad y de acuerdo a estas condiciones.
